 One Percent for Public Art in Private Development Program

On June 28, 2016 the Berkeley City Council passed the One-Percent for Public Art on Private Projects Ordinance.

On December 13, 2016 Berkeley City Council passed a change to the program guidelines that requires developers who elect to provide On-Site Publicly Accessible Art to pay an administrative fee equal to 5% of the 1% requirement directly to the Private Percent Art Fund prior to issuance of the building permit.

On January 24, 2017, Berkeely City Council passed a second reading of Ordinance No. 7,526-N.S. revising Berkeley Municipal Code Section 23C.23.050, the One-Percent for Public Art on Private Projects Ordinance, to allow developers the option of satisfying the Percent for Art requirements with a combination of on-site art and in-lieu payment. Therefore the ordinance now provides the developer with three options for allocating funds:

1. Include on-site publicly accessible artwork valued at 1% of construction costs; or

2. Pay an in-lieu fee to the Private Percent Art Fund valued at .8% of the construction costs

3. A combination of 1& 2: include on-site publicly accessible artwork valued at less than 1%, with an amount equal to 80% of the difference in value paid to the City as an in-lieu fee.
